By ordering for Bodyguard Workwear’s website, you agree and are bound to the terms and conditions set below. You are able to print off these terms and conditions for future reference.

Conditions Apply
1. Unless otherwise specifically agreed in writing by Bodyguard Safety Wear Ltd (Bodyguard Workwear), all quotations and contracts for the supply of goods by Bodyguard Workwear (“The Company”, “We”, “Us”, “Our”) made upon these Conditions of Sale ("Bodyguard Workwear’s Conditions") which shall at all times override any terms and conditions which the purchaser of such goods ("the Purchaser", “You”, “Your”) imposes or seeks to impose.
2. “Web site” “Website” or “Site” means the web site you are browsing when you clicked on a link to these General Terms and Conditions (www.bodyguardworkwear.co.uk), including all subsidiary pages.
3. No terms & conditions contained in the Purchaser’s purchase order, order confirmation, delivery note or any other document will form part of the Contact simply as a result of that document being referred to in the Contract.
Payment Terms
Prices
1. All prices displayed on both Bodyguard Workwear’s website, online publications and catalogues include the current applicable VAT, unless otherwise stated
2. All prices are correct at the time of publishing
3. All prices are subject to change without prior notice
4. The price charged to the Purchaser will be the clearly displayed, prevailing price at the time of order
5. There is no minimum order value on non-personalised goods
Availability
1. Bodyguard Workwear’s website is intended for people residing within the UK. The Purchaser agrees that by purchasing on the Bodyguard Workwear website:
  1. They are legally capable of purchasing and entering into binding contracts
  2. They are a resident of the UK
  3. They are accessing the Bodyguard Workwear website within the UK
2. Age restrictions apply to some goods such as tools and solvents. Bodyguard Workwear reserve the cancel any order if the Purchaser is found not to meet the age requirements for the goods purchased
3. All good are subject to availability. Whilst we endeavour to hold sufficient stock to meet all orders, if we have insufficient stock to supply the goods ordered and paid for by you, we will attempt to contact you via the contact details you have provided. We may at our discretion, process any part of the order which is available and in stock. Where goods are out of stock, we will refund you the price paid for such goods as soon as possible, or in the case of account customers, we may raise a credit for the value of the ‘out of stock’ goods invoiced to you.
Colour Reproduction
1. Colour samples and reproductions of products, embroidery and artwork samples are as accurate as the printing and electronic viewing device will allow
Retention of Title
1. The risk of the goods purchased will be yours from the time of delivery
2. The title and ownership of the goods will be passed to You when We receive full, cleared funds of all sums due in respect of those orders, including delivery charges
3. We reserve the right to cancel the contract, suspend deliveries or terminate any outstanding orders if you breach any payment terms.
Delivery
1. Terms and conditions for delivery are applicable exclusively in the UK
2. Delivery of goods will be deemed to take place at the your premises unless otherwise agreed.
3. We aim to deliver your goods in accordance with your selected delivery method, except for exceptional circumstances, but not more than 30 days after you place your order, unless otherwise agreed.
4. We reserve the right to deliver an order in installments by individual delivery shipments
5. Before placing your order, please refer to our delivery options and methods to ensure we can deliver to your address, and in the required timeframe.
6. A valid signature may be required on delivery
7. For health and safety reasons, and to avoid any damage to property, goods can only be delivered to the of a ground floor location at your designated delivery address. If the goods need to be transported from the delivery location, you must make your own arrangements at your own risk. Bodyguard Workwear will not be responsible for providing any further packaging, installation, or transport upon being delivered at your delivery address, unless otherwise agreed by us in writing.Delivery of the goods shall be completed on the goods arrival at the Purchaser’s premise
8. If the Purchaser does not accept delivery of the goods when they are ready for delivery, the good will have been deemed ‘delivered’, risk passed to the Purchaser (including loss or damage caused by Bodyguard Workwear’s negligence), Bodyguard Workwear may:

1. 1. store the goods for a maximum of 30 days but the Purchaser shall pay Bodyguard Workwear for all related costs and selling expenses (including the delivery charges which would have been liable if the goods had been delivered on time)
  2. sell the goods after 30 days at the best price readily obtainable, and charge the Purchaser for any shortfall below the readily obtainable best price
  3. cancel the order after 30 days, which will entitle Bodyguard Workwear to obtain compensation from the Purchaser for any loss of profit, including any other funds due to Bodyguard Workwear under these conditions
2. Any delivery dates provided by Bodyguard Workwear are intended to be an estimate. Bodyguard Workwear shall not be liable for any delay in delivery of the goods that is caused by unforeseeable circumstances, or due to the Purchaser’s failure to provide Bodyguard Workwear with correct and adequate delivery instructions
3. Bodyguard Workwear reserves the right to deliver an order in instalments by separate delivery shipments. Any failure to deliver one installment does not entitle the Purchaser to terminate the contract
4. The quantity of any consignment of goods is recorded by Bodyguard Workwear and dispatch from Bodyguard Workwear’s place of business. This will count as conclusive evidence of the quantity received by the Purchaser, unless the Purchaser can provide conclusive evidence proving the contrary
5. All shortages and damages to delivered goods must be reported to Bodyguard Workwear by telephone within 3 working days after receipt of goods at the Purchaser’s premises
6. All non-deliveries must be reported to Bodyguard Workwear by telephone within 10 working days of the dispatch date shown on invoice.
7. Damaged parcels should be checked in front of the courier’s delivery person, signed for and reported accordingly
Returns
1. The Purchaser may return part or the complete order of goods, provided that:
  1. The goods have not been personalised or made-to-measure
  2. The goods are returned to Bodyguard Workwear unused, undamaged, in the original packaging and suitable for re-sale
  3. Goods are not ear plugs, respiratory equipment, ear defenders, base layers, whistles, mouth pieces, underwear and socks due to hygiene reasons, unless faulty, unopened, unused and in its original condition
  4. The purchaser contacts Bodyguard Workwear within 14 days of receiving the goods
  5. The purchaser returns the goods within 14 days of Bodyguard Workwear authorising the return of the goods, along with a returns note and authorisation number (given when processing a returns request on Bodyguard Workwear’s website). Delivery costs for returning the goods are covered by the Purchaser, unless the fault is with Bodyguard Workwear (wrong item dispatched or faulty item). Return costs can differ depending on the size of Your order.
2. Refunds or credits will only be made after receipt and inspection of the goods
3. Refunds or credits will be made within 14 days of receiving the unwanted, faulty or incorrectly supplied goods.
4. Refunds will be made using the original payment method used to purchase the goods
Liability
1. Nothing in the conditions excludes or limits the liability of Bodyguard Workwear for death or personal injury caused by Bodyguard Workwear’s negligence, fraudulent misinterpretation, or for fraud
2. Bodyguard Workwear will not be liable for the following arising out of connection with the goods, delivery delays or failures, or any product defects:
  1. Direct or indirect loss/damage to profit, revenue, business, contacts, opportunities, savings, data, goodwill, reputation, business interruptions, or claims against your business from a third party
3. Goods are intended for UK use only, and we cannot confirm or guarantee that the goods supplied will comply with any laws, regulation or other standards applicable outside of the UK. All goods are sold in accordance with the manufacturer's specifications and are subject to qualifications, representations, standards or instructions supplied with the goods.
4. Bodyguard Workwear’s total liability to the Purchaser, in respect of all other losses caused by deliberate breach in contract by Bodyguard Workwear, it’s employees, agents or subcontractors shall not exceed the value of the Contract
Product Information
1. Bodyguard Workwear has made every effort to ensure that details and information provided on our website and other online publications are accurate at the time of issue, but Bodyguard Workwear accepts no liability in respect of any errors or omissions herein contained
2. Bodyguard Workwear gives no guarantees as to the accuracy or completeness of such product information, although Bodyguard Workwear’s policy is one of continuous improvement. The right is reserved to alter details and information when the need arises, and the customer should continue to check any details and information with Bodyguard Workwear before/during the time of purchase
Termination
1. Bodyguard Workwear may suspend further supply or delivery, stop any goods in transit or terminate the contract by notice in writing to you the Purchaser, if:
  1. The Purchaser is unable to pay debts when they are due
  2. The Purchaser is unable to pay debts when proceedings are or are reasonably likely to be commenced against you alleging bankruptcy or insolvency
  3. The Purchaser is unable to pay debts when an administrator, receiver or administrative receiver is appointed or is reasonably likely to be appointed over all or part of your undertaking and assets.
2. Upon termination of the contract, any payments you owe to Bodyguard Workwear, even if they are not yet due for payment, will be immediately due and payable. Bodyguard Workwear shall be under no obligation to supply further goods to the Purchaser

3. If payment is overdue in whole or in part, Bodyguard Workwear may (without prejudice to any of its other rights) recover or resell the goods or any of them and may enter upon the buyer's premises by its servants or agents for that purpose.
4. Until the title of the goods is transferred to the Purchaser, the relationship of the Purchaser to the company becomes fiduciary in respect of the goods and other goods supplied by Bodyguard Workwear to the Purchaser.
5. If the goods are sold or used before the title of the goods is passed to the Purchaser, Bodyguard Workwear to have the right to trace any proceeds thereof.
6. Until the title of the good is transferred to the Purchaser, the Purchaser shall store the goods safely at their own cost, separately from any other goods in their possession.
Delivery

Delivery costs for returning the goods are covered by the Purchaser, unless the fault is with Bodyguard Workwear (wrong item dispatched or faulty item)
2. The Purchaser agrees to pay 15% handling fee for non-faulty/unwanted goods
3. Refunds or credits will only be made after receipt and inspection of the goods
4. Refunds or credits will be made within 7 days of receiving the unwanted, faulty or incorrectly supplied goods.
